  • Late Cancellations: Requests for cancellations made within 12 hours of the event start time will not be eligible for refunds.

  • Rescheduling: Participants may reschedule for an alternate date based on availability. Each participant is permitted a maximum of two reschedule attempts. After two reschedule requests, any further cancellation will result in a 20% refund of the original purchase price, issued at the participant’s request.

Refund & Cancellation Policy

  • All Sales Are Final: Once a tarot reading has been completed and delivered, refunds will not be issued.

  • Cancellation Window: Clients may cancel their tarot reading within 8 hours of purchase for a full refund. However, cancellations after this period will not be eligible for refunds.

12. Governing Law & Dispute Resolution

12.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.

12.2. Dispute Resolution & Binding Arbitration

1. Agreement to Arbitration

By using the Nous Collective website and services, you agree that any disputes, claims, or controversies arising out of or relating to these Terms of Use, our services, or any transaction with Nous Collective shall be resolved exclusively through binding arbitration, rather than in court, except for claims that qualify for small claims court or as otherwise stated in this Agreement.

2. Governing Law & Arbitration Authority

  • For disputes involving users located in Canada, arbitration shall be conducted under the rules of the ADR Institute of Canada (ADRIC) in accordance with its Arbitration Rules.

  • For disputes involving international users, arbitration shall be conducted under the International Chamber of Commerce (ICC) Rules of Arbitration.

  • Arbitration proceedings shall be held remotely via video conference, unless otherwise agreed by both parties.

3. Arbitration Process

  • The arbitration will be conducted in English and presided over by a single neutral arbitrator, mutually selected by both parties.

  • The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction.

  • Each party shall have the right to legal representation at their own expense.

4. Confidentiality of Arbitration

All arbitration proceedings, including any evidence, arguments, and decisions, shall be strictly confidential and may not be disclosed to third parties, except as required by law.

5. Costs & Fees

  • Each party shall be responsible for its own legal fees.

  • Arbitration administrative costs shall be shared equally, unless the arbitrator determines otherwise.

6. Exception: Injunctive Relief & Intellectual Property Rights

Nous Collective retains the right to seek injunctive relief in a court of law to protect its intellectual property rights, confidential information, or proprietary interests without first submitting to arbitration.

7. Waiver of Class Actions

You agree that disputes will be resolved on an individual basis and not as part of a class action, collective, or representative proceeding.
